In the state of Washington both the insurance company and their insured parties have a duty to act in good faith. When insurance companies fail to meet certain legal standards or inappropriately deny coverage, an insured may be entitled to recover damages from the insurer for acting in bad faith. Damages may include enhanced damages and attorney fees – this may be true even if there is no coverage for a claim.
